Welcome to Saint Mask. The terms “we”, “us” and “our” refer to Saint Mask.

Saint Mask operates this shop and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (the “Services”).

Saint Mask is powered by Shopify Inc., Shopify Commerce Singapore Pte. Ltd. or Shopify International Limited, depending on where Saint Mask is located, which enables us to provide the Services to you.

These terms and conditions, together with all policies referenced here (these “Terms of Service”), describe your rights and responsibilities when using the Services.

Please read these Terms of Service carefully, as they contain important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you must not use or access the Services.

These Terms of Service do not limit any rights you may have under applicable consumer protection laws or any other statutory rights that cannot be waived.

1. Access and account

By agreeing to these Terms of Service, you confirm that you are at least the age of majority in your place of residence and that you have given us your consent to allow any of your minor dependants to use the Services on devices you own, purchase or manage.

To use the Services, including accessing or browsing our online shop or purchasing products or services, you may need to provide certain information, such as your email address, billing details, payment information and delivery details.

You represent and warrant that all information you provide is accurate, current and complete, and that you have all necessary rights to provide it.

You are solely responsible for keeping your account credentials secure and for all activity carried out through your account. You must not transfer, sell, assign or license your account to another person.

2. Our products

We make every effort to represent our products and services accurately in our online shop. However, product colours and appearance may vary depending on the device you use and its display settings.

We do not guarantee that the appearance or quality of products or services you purchase will meet your expectations or appear exactly as displayed in our online shop.

Product descriptions may be changed at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of products offered to any person, geographical region or jurisdiction on a case-by-case basis.

3. Orders

When you place an order, you make an offer to purchase and authorise us and our payment processors to charge the full order amount to your selected payment method.

Saint Mask reserves the right to accept or decline your order for any reason, at its discretion, subject to applicable law. Your order is not accepted until Saint Mask confirms acceptance. Payment must be received and processed before an order is accepted.

Please review your order carefully before submitting it, as we may be unable to accommodate cancellation requests after acceptance.

If your order is declined, amended or cancelled, we may attempt to notify you using the email address, billing address or telephone number provided when you placed your order.

Returns and exchanges are subject to our Returns and Refund Policy. This does not limit your rights under applicable law.

You represent and warrant that your purchases are for personal or household use and not for commercial resale or export.

4. Prices and billing

Prices, discounts and promotions may change without notice. The price charged for a product or service will be the price in effect when you place your order, as stated in your order confirmation email.

Unless expressly stated otherwise, published prices exclude taxes, delivery, handling, customs duties and import charges.

Prices in our online shop may differ from prices offered in physical shops, other online shops or shops operated by third parties.

We may occasionally offer promotions governed by separate terms and conditions. If the terms of a promotion conflict with these Terms of Service, the promotional terms will take precedence.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases. You also agree to update your account and other information promptly, including your email address, credit card numbers and expiry dates, so that we can complete your transactions and contact you when necessary.

You represent and warrant that:

1. You are authorised to use the payment method provided.

2. The information supplied for that payment method is true, accurate and complete.

3. Your payment provider will honour the charges you incur.

4. You will pay all charges at the published prices, including delivery and handling charges and any applicable taxes.

5. Shipping and delivery

Unless stated otherwise, we are not responsible for shipping or delivery delays. Delivery times are estimates only and are not guaranteed.

We are not responsible for delays caused by carriers, customs processing or events beyond our control.

To the fullest extent permitted by applicable law, ownership and the risk of loss pass to you when we hand the products over to the carrier, unless applicable law provides otherwise.

We are not responsible for delays or failures caused by events beyond our reasonable control, including carrier or customs delays, natural disasters, severe weather, labour disputes, supply shortages, utility or telecommunications outages, cyber incidents, government action or similar events.

6. Intellectual property

The Services, including all trade marks, branding, text, images, graphics, product reviews, videos and audio, are owned by Saint Mask, its affiliates or licensors and are protected by trade mark, copyright and other intellectual property laws in the United States and other countries.

Product listings are also managed and owned by Saint Mask.

Purchasing or receiving a product does not grant you any intellectual property rights, including patents, copyright, trade marks or other proprietary rights relating to the product, its design, software or underlying technology. These rights remain exclusively with Saint Mask or the original rights holder.

These Terms of Service permit you to use the Services for personal, non-commercial purposes only.

Without our prior written consent, you must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit any material from the Services.

Except as expressly provided in these Terms of Service, nothing grants or should be interpreted as granting you a licence or other rights under any patent, trade mark, copyright or other intellectual property belonging to Saint Mask, Shopify or a third party.

Unauthorised use of the Services may breach applicable intellectual property or other laws. All rights not expressly granted are reserved by Saint Mask.

Saint Mask’s names, logos, product and service names, designs and slogans are trade marks of Saint Mask, its affiliates or licensors. You must not use them without Saint Mask’s prior written permission.

Shopify’s name, logo, product and service names, designs and slogans are trade marks of Shopify. All other names, logos, product and service names, designs and slogans appearing in the Services are trade marks of their respective owners.

7. Optional tools

As part of the Services, you may be given access to tools provided by third parties that we neither monitor nor control and over which we have no input.

You acknowledge and agree that access to these tools is provided “as is” and “as available”, without warranties, representations or conditions of any kind and without endorsement.

We accept no liability arising from or relating to your use of optional third-party tools.

Any use of these tools is entirely at your own risk and discretion. You should ensure that you understand and approve the terms on which the relevant third-party providers make them available.

9. Relationship with Shopify

Saint Mask is powered by Shopify, which enables us to provide the Services to you. When you use the Services, your device communicates with Shopify’s systems to deliver the Services. Section 10 explains how Shopify uses and processes information from these interactions.

However, all sales and purchases made through our shop are directly between you and Saint Mask.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of a sale between you and Saint Mask, including any injury, damage or loss arising from the purchase of products or services.

You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or relating to your purchases and transactions with Saint Mask.

10. Privacy

Our Privacy Policy explains how we may collect, use and disclose personal information arising from your use of the Services. By using the Services, you acknowledge that you have read it.

We are under no obligation to keep your Feedback confidential, compensate you for it or respond to it.

We may, but are not obliged to, monitor, edit or remove Feedback that we consider, at our sole discretion, unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable, or that infringes another party’s intellectual property rights or these Terms of Service.

You agree that your Feedback will not infringe any third-party rights, including copyright, trade marks, privacy, personality rights or other personal or proprietary rights.

Your Feedback must not contain defamatory, unlawful, abusive or obscene material, computer viruses or other malware that could affect the operation of the Services or any related website.

You must not use a false email address, impersonate another person or mislead us or third parties about the origin of your Feedback.

You are solely responsible for your Feedback and its accuracy. We accept no responsibility or liability for Feedback posted by you or a third party.

12. Errors, inaccuracies and omissions

Information available through the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, delivery charges, transit times or availability.

We reserve the right to correct errors, inaccuracies or omissions, update information or cancel orders where information is inaccurate, including after an order has been submitted.

If we cancel an order after payment has been taken, we will issue any refund required by applicable law.

13. Prohibited uses

You may access and use the Services for lawful purposes only. You must not directly or indirectly access or use the Services:

i. To engage in conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or that we determine may harm Saint Mask, Shopify or users of the Services, or expose them to liability.

You also agree not to:

a. Upload or transmit viruses or other malicious code that could affect the functionality or operation of the Services.
b. Reproduce, duplicate, copy, extract, sell, resell or exploit any part of the Services.
c. Collect or track other people’s personal information.
d. Use the Services for spam, phishing, pharming or pretexting.
e. Use robots, spiders, scraping tools, data collection or extraction tools, automated devices or processes, AI tools such as agentic AI, or other automated or manual means to access the Services.
f. Interfere with, bypass or circumvent security or authorisation features, robot exclusion headers or other measures used to restrict access to the Services.

We reserve the right to suspend, disable or terminate your account at any time without notice if we determine that you have breached any part of these Terms of Service.

14. Agent terms

14.1

This section (the “Agent Terms”) applies if you use, permit, enable or cause an Agent to access, use or interact with any of the Services.

“Agent” means software or a service that performs an autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or organisation, and that may operate on someone’s behalf or using their device without direct supervision.

14.2

No Agent may access, use or interact with the Services unless it identifies itself and operates in strict compliance with section 14.4 at all times.

No Agent may access, use or interact with the Services if we have requested that it refrain from doing so.

14.3

We may limit whether and how an Agent accesses, uses or interacts with the Services, including through technical measures.

14.4

Agents must:

a. Identify every HTTP/HTTPS request as originating from an Agent and disclose the Agent’s name by including “Agent/[agent name]” in the request’s user-agent string.
b. Not conceal or obscure that access, use or interactions originate from an Agent, including by imitating human behaviour or interaction patterns, or completing or bypassing CAPTCHAs or measures intended to distinguish computer use from human use.
c. Answer truthfully any question or prompt seeking to establish whether interactions originate from a human or a computer.
d. Not bypass or otherwise evade measures intended to block, limit, modify or control whether and how Agents access, use or interact with the Services.

15. Termination

We may terminate this agreement or your access to all or part of the Services at our sole discretion, at any time and without notice. You remain responsible for all amounts due up to and including the termination date.

The following sections will continue to apply after termination: Intellectual property, Feedback, Termination, Disclaimer of warranties, Limitation of liability, Indemnification, Severability, Waiver and entire agreement, Assignment, Governing law, Privacy, and any other provisions that by their nature should survive termination.

16. Disclaimer of warranties

Information presented on or through the Services is made available for general information purposes only. We do not warrant its accuracy, completeness or usefulness.

Any reliance you place on this information is strictly at your own risk. We disclaim liability and responsibility arising from reliance on these materials by you, another visitor to the Services or anyone informed of their contents.

Except as expressly stated by Saint Mask, the Services and all products offered through them are provided “as is” and “as available”, without representations, warranties or conditions of any kind, whether express or implied.

This includes implied warranties or conditions of merchantability, satisfactory or merchantable quality, fitness for a particular purpose, durability, title and non-infringement.

We do not guarantee, represent or warrant that your use of the Services will be uninterrupted, timely, secure or error-free.

Some jurisdictions restrict or do not permit the exclusion of implied or other warranties, so these exclusions may not apply to you.

17. Limitation of liability

To the fullest extent permitted by law, Saint Mask, our partners, directors, officers, employees, affiliates, agents, contractors, service providers and licensors, and those of Shopify and its affiliates, will not be liable for any injury, loss, claim or direct, indirect, incidental, punitive, special or consequential damages of any kind.

This includes lost profits, lost revenue, lost savings, lost data, replacement costs or similar damages, whether arising in contract, tort, including negligence, strict liability or otherwise, from your use of the Services or products purchased through them.

This limitation also applies to other claims relating in any way to your use of the Services or a product, including errors or omissions in content, or loss or damage resulting from the use of the Services or any content or product posted, transmitted or otherwise made available through them, even if advised of the possibility.

Nothing in these Terms of Service excludes or limits liability that cannot be excluded or limited under applicable law.

18. Indemnification

You agree to indemnify, defend and hold harmless Saint Mask, Shopify and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers against losses, damages, liabilities or claims, including reasonable legal fees, payable to third parties arising from:

1. Your breach of these Terms of Service or documents incorporated by reference.

2. Your breach of any law or third-party rights.

3. Your access to and use of the Services.

We will notify you of any claim subject to indemnification. A failure to notify you promptly will not release you from your obligations unless you are materially prejudiced by that failure.

We may control the defence and settlement of such a claim at your expense, including the choice of legal advisers. However, we will not settle a claim that imposes non-financial obligations on you without your consent, which must not be unreasonably withheld.

You agree to cooperate in the defence of indemnified claims, including by providing relevant documents.

19. Severability

If any provision of these Terms of Service is found to be unlawful, void or unenforceable, it will remain enforceable to the fullest extent permitted by applicable law. The unenforceable portion will be treated as severed from these Terms of Service.

This will not affect the validity or enforceability of the remaining provisions.

Nothing in these Terms of Service limits your rights under applicable consumer protection laws or other laws that cannot be waived by contract. If any part of these Terms conflicts with those rights, those rights will prevail.

20. Waiver and entire agreement

Our failure to exercise or enforce any right or provision of these Terms of Service does not constitute a waiver of that right or provision.

These Terms of Service, together with policies or operating rules published by us on this website or in relation to the Services, constitute the entire agreement and understanding between you and us.

They govern your use of the Services and replace all previous or contemporaneous agreements, communications and proposals, whether oral or written, including earlier versions of these Terms of Service.

Any ambiguity in interpreting these Terms of Service must not be construed against the party that drafted them.

21. Assignment

You must not delegate, transfer or assign this agreement or any rights or obligations under these Terms of Service without our prior written consent. Any attempt to do so will be void.

We may transfer, assign or delegate these Terms of Service and our rights and obligations without your consent or prior notice.

22. Governing law

These Terms of Service are governed by the laws of the jurisdiction in which Saint Mask is headquartered or incorporated, without regard to conflict-of-law principles.

You and Saint Mask agree to the jurisdiction and venue of the courts located in that jurisdiction, except where prohibited by applicable law.

Nothing in this section limits your rights to bring claims in your local courts or rely on mandatory laws applicable in your place of residence.

These Terms of Service may be available in languages other than English.

If there is an inconsistency or conflict between the English version and a version in another language, the most current English version will take precedence.

Disputes arising from these Terms of Service will be resolved in English unless Saint Mask determines otherwise at its sole discretion or applicable law requires otherwise.

The headings in this agreement are included for convenience only and do not limit or otherwise affect these Terms of Service.

25. Electronic communications

By using the Services or placing an order, you agree that we may send transactional and service-related communications electronically, including by email, account notification or notices published through the Services.

These communications may relate to your orders, account, purchases, returns, these Terms of Service or other matters concerning the Services.

We reserve the right, at our sole discretion, to update, amend or replace any part of these Terms of Service by publishing changes on our website. You are responsible for checking our website periodically for changes.
